Terms of Use
These Terms of Use set out the basis on which you ("the site user") will be permitted to use www.trustedhousesitters.com ("our site"). Your full acceptance of and compliance with these Terms of Use is an essential requirement of your permission to use our site. By using our site in any way, you are indicating your irrevocable acceptance of these Terms of Use. If you do not agree to these Terms of Use, please do not use our site.
Who we are
The contract created by these Terms of Use is between us and you, the user. We are TrustedHouseSitters Limited, a UK limited company registered under company number 07227301 with its registered office at FriendJames, 169 Preston Road, Brighton, BN1 6AG, England.
You
The member is the individual or entity specified by the member when registering with our site. The member confirms that the member details, including where applicable the member company registration number, address and contact details provided to us on subscribing are correct and that the advertiser is free to enter into these Terms of Use.
Eligibility
You may access our site from most locations in the world. Please do not do so if there is any legal or regulatory prohibition in your location which might restrict your right of access to our site. We cannot be responsible for any consequences of your use of our site contrary to local applicable law and regulation.
You must be at least 18 years of age to use our site.
Privacy and security of data
We take data protection seriously. Please refer to our Privacy Policy for applicable privacy terms. Registration as a member means you are agreeing that we can collect, store, and use your information as set out in the Privacy Policy. We will only process your details in accordance with our Privacy Policy Statement.
Site Objectives: The main purposes of our site are (a) to provide a convenient means for owners of property to advertise the availability of their property for housesitting assignments and to view profiles of and contact interested housesitters and (b) enable housesitters to conveniently view advertised housesitting assignments and to advertise their credentials and contact property owners. Our site may also publish other information and provide other services which we consider to be complementary to our core purposes from time to time.
Subscribing: By subscribing to a membership with our site or taking a free membership or promotional offer, providing an email address, password and contact details to us, you are registering for membership with our site as a member. As a member of our site, you are provided with your own personal advert or listing to the site offering your services as a housesitter or homeowner. You can update your advert with current information. By advertising you are inviting homeowners or housesitters registered with us to contact you. Membership allows you to use the site to look for housesitting assignments and to contact other members. We may change the format, display and information contained in our listings at any time.
Log in details and passwords
All log in details and passwords for your listings are your responsibility. Please let us know if your log in details have been misused. We suggest that you change your password regularly.
Free trials
If you are subscribing for a free trial to our site, you may be allowed to use our facilities free of charge for a set period of time, as specified in connection with the free trial. After expiry of your free trial, our standard charges apply. Only one free trial is available per person. We have the right to refuse a free trial at our discretion. At the end of your free trial, we may contact you to prompt you to renew your membership.
Payment for and duration of listings
Housesitters are required to pay a subscription fee for their chosen period of membership. This enables them to create an online profile and to contact homeowners in relation to advertised housesitting assignments. Homeowners are able to advertise their housesitting assignments on our site for free, but to contact interested housesitters, they have to pay a subscription fee. Fees are as advertised on the site and many be subject to change from time to time. You can choose whether or not to automatically renew your membership on the expiry of the initial period.
Payment is required to be made online in advance for that period before we will display the listing. Advertisements and profiles may be deleted at the end of the period for which payment has been received if not renewed.
Where VAT is charged, this will be indicated in the online payment process.
We shall be entitled to use a reputable payment agency to process online payments on our behalf.
Cancellation of a listing
You may delete a listing before the expiry date if you choose to do so, for example where the housesitting assignment has been allocated or withdrawn. Simply follow the online instructions to do this. The listing is not transferable to any other property or assignment and payments already made are non-refundable. Only in exceptional circumstances such as natural disaster, death or severe illness of a member or member’s immediate family may a refund be offered, only eligible in the first 7 days of membership and if the service has not been used and emails not sent to either house sitters or homeowners and will be subject to a $10USD fee to cover admin handling and credit card fees.
Standards: You agree to ensure that all content that you post or transmit through the site is both accurate and current and remains both accurate and current during the period that you use the site. We reserve the right to delete your profile from the site if it is thought that you have not met your registration obligations, or your email account is not currently valid or for any other reason in our reasonable determination.
Housesitter References: Random checks can and will be made on any references or any other material provided by you as part of your listing.
Legal Notice: We intend that all of our members using our site are good faith home owners or housesitters. However, we are not able to verify them or to warrant that they are who they say they are or warrant any other information that they post on our site. In the event that we find out or are alerted that any member is not acting in good faith we shall investigate this and take remedial action if necessary, which shall principally be to correct or delete the information about them on the site. You expressly understand and agree that you use the site at your own risk and we shall not be responsible for any delays in receiving or posting content or site unavailability.
General website usage permissions: Any rights not expressly granted in these Terms of Use are reserved. TRUSTEDHOUSESITTERS is our trade mark and you may not make any commercial use of it without our written permission. Provided that you comply fully with these Terms of Use, we permit you to use our (or our licensors') intellectual property published on our site for the purposes of accessing, printing and downloading extracts from our site for your own private non-trade use on the following basis:
- no documents or related graphics on our site are modified in any way;
- no graphics on our site are used separately from the corresponding text; and
- our copyright and trade mark notices and this permission notice appear in all copies.
Copyright and database rights: Unless otherwise stated, the content on our site contains material which is protected by copyright and other intellectual property rights. For the purposes of these Terms of Use, any use of extracts from our site other than permitted above for any purpose is prohibited. You agree that we may use and reproduce at our discretion any text or other materials that you may submit to us (if any) e.g. photographs, feature listings etc through the site for our reasonable purposes (including marketing and press releases to promote our business) without infringing your copyright, moral rights or any other intellectual property rights provided that our use is in compliance with our Privacy Policy.
Advertising on our site: In addition to the listings on our site, we may host other third-party advertisements on our site and we do our best to ensure that advertisements are relevant and responsible. We will endeavour to clearly label all advertising on our site and/or present it in a way that makes a clear distinction between advertising, promotions, advertorial and site editorial. We cannot be responsible for the products and services of third-party advertisers, but if you have any complaints about the advertising or advertisers on our site please let us know, using the contact details on the site, and we will give this due consideration.
Misuse of information: Please let us know immediately if you become aware of or suspect that any of your personal information has been misused in any way. We take our site security very seriously and will take all action that we consider appropriate to remedy the situation.
Enquiries about property or housesitting services
Please do not contact us with relation to specific questions you may have regarding any property or housesitting services advertised on our site. Please use the appropriate links on the site to contact the property owner or housesitter, as appropriate. It is the responsibility of the member to respond to enquiries from you in a prompt, professional and courteous manner. It is not part of our service to respond to enquiries resulting from listings on our site, or to pass on information to members following such enquiries. We accept no responsibility for losses that may result from our not doing so.
Disclaimer: While we try to ensure that the information and advertisements on our site are correct, we do not warrant the accuracy, reliability, completeness or availability of the material published by us. The information provided on the site is collated from a number of sources for your convenience and we are largely dependent on third-party sources, which we cannot check. The material on our site is therefore provided "as is". To the maximum extent permitted by law, and subject to any consumer or statutory rights applicable pursuant to our Terms of Use, we exclude all representations, warranties, conditions and other terms and all liability (including direct, indirect, consequential and special losses) including, without limitation, which, but for this legal notice, might have an effect with relation to our site.
Links to and from other websites: Links to third-party websites on our site are provided solely for your convenience. If you use these links, you leave our site. We have not reviewed all of these third-party websites and do not control and are not responsible for these websites or their content or availability. We therefore do not endorse or make any representations about them, or any material found there, or any results that may be obtained from using them. If you decide to access any of the third-party websites linked to our site, you do so entirely at your own risk.
Liability for losses resulting from malfunctioning of software
We do not accept any liability for any losses to you arising due to the malfunctioning of our software or third party misuses of our site. We use all reasonable endeavours to ensure that our site is professionally hosted in a secure environment. We accept no liability for any interruption in service; loss of some or all site facilities; criminal hacking or unauthorised intrusion into the site; loss of data at any time; special, consequential or indirect losses of any kind.
Availability of our site: While we endeavour to ensure that our site is normally available 24 hours a day, we shall not be liable if for any reason our site is unavailable at any time or for any period. In addition, we may suspend the site and/or your access to it at any time at our sole discretion. If you breach any of these Terms of Use, your permission to use our site automatically ceases.
Liability for damage caused by third-parties: We are not liable for any damages resulting from your use of any documentation, agreements or any content provided on the site. We are not liable for any unauthorised use or alterations in information members display on the site. We are not liable for any conduct of a third-party on the site.
You agree to hold us harmless from any liability or claim arising out of information you submit or pass through the site. You agree that we are not liable for any loss or damages arising from your use of the site or for any physical damages and or theft of your property.
General Limitations
So far as permitted by law, and except in respect of death or personal injury arising from our negligence and without prejudice to your rights as a consumer, we exclude any liability for loss or damage of any kind resulting from the use of the site or any information, content, advertisements or products provided or distributed through the site including, without limitation, economic loss or any special, indirect, incidental or consequential loss or damage, whether or not the possibility of such loss has been notified to us. Your statutory rights are not affected.
Termination
We may terminate your use of our site for any reason with immediate effect by giving you notice by email or by other reasonable means at our discretion except with relation to advertisements already placed by you unless:
a) you have breached these Terms of Use and have failed to comply with our request for you to remedy such breach (if it is capable of breach) within the time notified to you; or
b) you become insolvent or bankrupt or proceedings are initiated in this regard against you, you cease or threaten to cease trading or are unable to pay your debts as they fall due.
Changes to these Terms and Use
We may make changes to these Terms of Use at any time by posting revisions on our site. Any such changes shall take effect automatically 14 days after the date on which they are posted by us. Your continued use of our site after any changes have been posted to the site constitutes your full acceptance of them. If you do not accept our changes, you must not make any further use of our site.
General Legal Matters
a) These Terms of Use constitute the entire agreement between you and us.
b) Any failure by us to exercise or enforce any part of these Terms of Use shall not mean that we have waived our rights to do so in the future.
c) If at any time any provision of these Terms of Use are or become illegal, invalid or unenforceable in any respect that shall not affect the legality or validity or enforceability of any other provision.
d) The Contracts (Rights of Third Parties) Act 1999 shall not apply to these Terms of Use.
e) These Terms of Use and the relationship between you and us shall be governed by the laws of England and both parties agree to submit to the exclusive jurisdiction of the English courts.
